Terms & Conditions

These Terms & Conditions (“Terms”) apply to all landscaping, construction, turf installation, garden installation, and maintenance services provided by CreationScapes (“we”, “us”, “our”). By requesting a quote, accepting a proposal, or engaging our services, you agree to these Terms.
1. Quotes and Pricing
Our quotes are valid for 14 days unless otherwise stated.
Quotes are based on the information provided at the time of inspection or enquiry. If site conditions differ from what was originally presented, we may revise the quote.
Additional works requested by the client will be charged separately.
2. Acceptance of Work
Work begins once the client has accepted the quote in writing (email is sufficient) and any required deposit has been paid.
By accepting a quote, the client confirms they have read and agree to these Terms.
3. Deposits and Payments
A deposit may be required before work commences, depending on project size and material requirements.
Progress payments may be scheduled for larger projects.
Final payment is due upon completion of the agreed work unless specified otherwise.
Late payments may result in withheld services, interest charges, or recovery action at the client’s cost.
4. Variations and Additional Work
Any changes to the original scope must be agreed to before extra work is performed.
Variations may include:
- Unforeseen site issues
- Client-requested changes
- Additional materials or labour
All variations will be itemised and charged accordingly.
5. Site Conditions and Access
The client must ensure clear and safe access to the site for vehicles, machinery, and personnel.
The client is responsible for identifying underground services such as pipes, irrigation, electrical lines, data cables, and stormwater systems.
We are not liable for damage caused due to unmarked or inaccurately marked underground services.
6. Materials and Products
We may recommend specific materials, plants, or products based on quality and suitability, but availability can vary.
If a product or plant is unavailable, we may substitute it with a similar option of equal or higher quality, with the client’s approval.
Ownership of materials passes to the client once full payment has been received.
7. Turf, Plants, and Natural Materials
Turf and plants are living products affected by:
- Weather
- Watering
- Soil conditions
- Maintenance
Once installed and handed over, ongoing care becomes the responsibility of the client unless a maintenance service is booked.
We are not responsible for deterioration caused by lack of water, heat stress, pests, or improper care after handover.
8. Weather and Delays
Landscaping work is weather-dependent.
We may reschedule work for safety or quality reasons due to rain, extreme heat, or unsuitable site conditions.
We are not liable for delays outside our control.
9. Safety and Site Conduct
We follow all relevant safety standards and regulations.
Clients must not enter active work zones unless authorised by our team.
Children, pets, and personal property must be kept clear of the work area.
10. Rubbish Removal and Clean-Up
Our quotes include removal of construction waste unless stated otherwise.
Green waste or excess material created during client variations may incur additional disposal charges.
11. Maintenance Services
Maintenance plans are tailored to each property.
The health and presentation of turf, plants, and gardens depend on environmental conditions and client care between visits.
Missed or cancelled visits may impact results and may still be chargeable if cancelled without sufficient notice.
12. Warranties
We warranty our workmanship for a reasonable period subject to the nature of the work performed.
Living materials (plants, turf) are not covered by warranty once handed over unless a maintenance plan is in place.
Damage caused by misuse, neglect, or external factors is not covered.
13. Liability
To the fullest extent permitted by law, we are not liable for:
- Loss or damage caused by factors outside our control
- Pre-existing site issues
- Damage due to natural events such as storms, drought, pests, or soil movement
- Indirect or consequential loss
Nothing in these Terms excludes rights under Australian Consumer Law.
14. Client Responsibilities
Clients must:
- Provide accurate information for quoting
- Maintain adequate irrigation and care after completion
- Ensure safe access and clear work areas
- Make timely decisions when approvals are needed
- Pay all invoices on time
15. Cancellation
Clients may cancel scheduled work by giving reasonable notice.
Deposits or material costs already incurred may not be refundable.
If work has commenced, the client is responsible for all costs up to the cancellation date.
16. Photos and Marketing
We may take photos or videos of completed work for portfolio and marketing use.
If the client prefers not to have their property featured, they must advise us in writing before work begins.
17. Privacy
We handle all personal information in line with our Privacy Policy, available on our website.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia.
